HB 4560 (Thapedi) Amends the Manager Licensing Act to exempt master and self-managed associations from paying the annual fee, caps the fee that an association pays annually at $1,000 and require the Dept. of Finance and Professional Regulation to prepare a detailed report of income and expense.  ACTHA position:  This bill was initiated by ACTHA and has the support of CAI.

 

HB 4438 (Nekritz)  Amends the ICPa to prohibit proxy voting.  ACTHA position:  Opposed

 

HB 4134 (Feigenholtz) Adds language in to the ICPA to specifically state that boards may regulate smoking in the association.  ACTHA position: Neutral

 

HB 3979 (Nekritz)  Provides that condominium bylaws shall provide that an owner may not vote by proxy in a board election but may vote by mail.  ACTHA position:  Oppose

 

HB 3950 (Nekritz)  Amends the ICPA.  Adds that high speed internet to cable TB as a type of easement that may be granted.  ACTHA position: Support

 

HB 3337 (Nekritz) Amends the Condominium Property Act. Provides that the bylaws of an association shall provide that a unit owner may not vote by proxy in a board officer election, but may vote by mail. Makes related changes. House Rules Committee ACTHA Position:  Oppose

 

SB 2954 (Althoff) Amends the ICPA.  Provides that condo instruments may provide for an alternative formula for assessment of common expenses that are specifically enumerated in the condo instruments if approved by 3/5ths of the owners.

 

SB 2817 (Silverstein)  Deletes the provision in the Illinois Condominium Property Act requiring a board to disclose that it has waived the requirement for a reserve study in the financial statements and to prospective buyers.  ACTHA position: Opposed




SB 2037 (Sullivan) Amends the Elevator Safety & Regulation Act to state that certificates of operation that are located in not-for-profit buildings and limited to use for one floor below ground level and one floor above ground level and for which the organization has a maintenance contract with an elevator maintenance company, the renewal is five years instead of annually.  Signed into law.  Public Act 97-0310.  ACTHA Position: Supports
