Educational programs:

ACTHA will offer two tracks of educational programming. Attendees are able to select one of three choices for the time period 9:30 - 10:30 a.m. and noon - 1 p.m. There is ample opportunity to visit vendor booths, view the "speed learning" demos and enjoy a continental breakfast.

9:30 - 10:30 a.m. (select from one of the two choices below):

  1. Contracts - You Must Dot Your I's and Cross Your T's: If you don't watch your P's and Q's you could get entangled in a contract with no clean exit. Whose contract is it? Yours or the vendor's? Understanding the elements of a contract from describing the project, determining the specifications, reviewing bids, and supervising the project is not sufficient unless you are trained in contract law. This session will expose you to both the legal and practical facets of project contracts. Presenters: Scott Rosenlund of Fullett, Rosenlund & Anderson PC and Paul Houillon of Connected Property Management
  2. Owner versus Association / Here Comes the Judge:  Non-owner resident sues for disability discrimination and the association’s D&O insurance carrier tries to avoid defending the case; a unit owner/former director sues the association alleging fraudulent concealment of a loan; and a unit owner sues the board for a defective declaration amendment and there is inadequate D&O coverage so the association sues its insurance broker. All true!Find out how to protect your association.Presenters: Nancy Ayers of Mesirow and Mike Kim of Michael Kim Associates
  3. Community Association Managers - Are You Legal?: The Community Association Manager Licensing Act and Managers will be licensed once the proposed rules have been approved.   If you are a Manager, do you know if the Act applies to you and what you need to do to get licensed? What do Association boards need to know to make sure their manager is legal? Don't take chances or there are consequences to pay! Presenters: Angela Falzone of Association Advocates and a member of the Licensing Advisory Board and Mark Pearlstein of Levenfeld Pearlstein

Noon - 1 p.m. (select from one of three choices below):

  1. Cyber Fraud - Data in the Cloud / Friend or Foe?: Day by day advancements in technology cause both pain and pleasure. Getting the job done faster and easier is pure bliss. But the learning process brings frustration and sometimes distress when things don't go right and then, curses...the unexpected happens and realization sets in that you and the computer are not invincible. A crafty geek stole your data and more. Keep your identity, data, money and reputation safe by learning how to protect your cyberspace. Presenter: Tom Engblom of Community Association Banc/Condo Certs
  2. Homeowner's Rights & Responsibilities - You Can't Make Me!: Can an owner make the board produce association records for review? Can a board make an owner or tenant obey the community rules? These are just some of the frequent skirmishes encountered by owners and boards. Both owners and boards have rights as well as responsibilities and this session will relieve the ambiguity and provide constructive procedures so both parties will be able to live up to their responsibilities while enjoying their rights. Presenters: Pat Bialek of Vanguard Community Management and William Chatt of Erwin Law Firm
  3. Develop a Maintenance Schedule - Stay on Top of Your Game: Knowing when to plow the snow and mow the lawn and having it spelled out in your contracts, is not enough. When your finances are stressed and depressed, you need to think and plan creatively. Examine your budget to identify the critical and the "nice but not necessary" items. Prioritizing is a requirement and so is learning how to budget your projects and normal maintenance in phases before the dollars run out. Presenters: Rich Hiles of Lieberman Management and Sean Schutten of 3eReserves
